Video: Environmental case law
The Environmental Protection Act 1990 is the bedrock of UK environmental law, but there are other laws and regulations, including some laid down by Brussels, such as the EU Waste Framework Directive which are (as we learn) of increasing significance.
We look at seven classic cases, starting with the so-called ‘ARCO Chemie’ case and National Grid Gas v The Environment Agency (2007), which deal with the definition of waste and contaminated land respectively.
As well as discussing the key cases in the areas of water pollution and nuisance, we learn about the perils of falling foul of ‘strict liability’ clauses and we hear how environmental law may develop in the coming years.
