Guidance on agreements with the secretary of state for transport under section 278 of the highways act 1980 (draft)
Sets out the basic framework and principles involved in the process of: determining the form of a section s278 agreement; satisfying the prerequisites of a s278 agreement; providing suitable mechanisms for cost recovery; dealing with any land conveyance necessary for dedication to public highway; how the works would be carried out; and also providing basic formats of s278 agreements with draft core documents.
