ADN Highway adoptions - the adoption of roads into the public highway (1980 Highways Act)
Comprises advice on how the adoption of roads in England can be carried out by highway authorities to make them maintainable at public expense. Covers: operation of section 38 agreements; operation of the private street works code and adoption after execution of street works; how the advance payment code works; and road adoption using section 37 of the 1980 Highways Act. Also includes a set of planning conditions which aims to ensure that arrangements for the future management and maintenance of new roads within developments, is confirmed at the planning stage.
Superseded by Highways adoption. The adoption of roads into the public highway (1980 Highways Act) (DFT, 2022). Supersedes Draft planning conditions (and notes) for adoption of new roads (DFT, 2012).
