Abstract

Relates to SR 2015/187, which allow councils and the Department of the Environment, in certain circumstances, to modify and discharge planning agreements as part of a two-tier planning system. The changes provide new powers for councils which allow them to carry out functions in relation to the modification and discharge of planning agreements. In addition, the Department will have powers to enter into, modify and discharge planning agreements in respect of applications for regionally significant development (including applications for major development that are to be treated as regionally significant).
