Practice Advice Note 9 Development control - handling appeals

Abstract

The correct handling of a planning appeal is vital if all the issues involved in connection with contentious development are to be adequately investigated, and a proper decision reached on whether or not permission should be granted. If the appeal proceeds to a public enquiry or hearing, a serious shortcoming by one side may also result in an award against them of the costs incurred by the other. This note thus seeks to point out some of the problems, and advise on good practice.
