Abstract

Relates to the draft Scheme for construction contracts (Scotland) amendment regulations 2011, which make changes to the Scheme for Construction Contracts (Scotland) Regulations 1998 following changes to the primary legislation, namely Part 2 of the Housing Grants, Construction and Regeneration Act 1996 by Part 8 of the Local Democracy, Economic Development and Construction Act 2009. Looks at: oral construction contracts; allocation of the costs of adjudication; correction of clerical or typographical errors in the adjudicator's decision; changes to the current payment framework; and clarification of the circumstances around payment.
